General Terms and Conditions of Sale for the products sold on www.chateau-la-coste.com

Article 1 - Subject

These General Terms and Conditions of Sale apply without restriction or reserve to all the sales concluded by SARL LA COSTE DISTRIBUTON (or “Vendor”) with all non-professional buyers, hereinafter referred to as “the Customer”, wishing to acquire the products sold by SARL LA COSTE DISTRIBUTION on its website www.chateau-la-coste.com

The products presented on this website are available for sale throughout mainland France and EUROPE.

These Terms and Conditions apply to the exclusion of any other conditions and, in particular, those that may apply in the context of other distribution and retail circuits.

These General Terms and Conditions of Sale can be accessed at any time on this website and, if necessary, will prevail over any other version or any other contradictory document.

Unless otherwise stipulated, the data saved by SARL LA COSTE DISTRIBUTION constitutes proof of all the transactions.

Modifications to these General Terms and Conditions of Sale are enforceable against users of the site from the moment they are put online and cannot be applied to transactions concluded previously.

The order’s confirmation by the Customer implies the unconditional acceptance of these General Terms and Conditions of Sale.

 

Article 2 – Prices

The prices of our products are indicated in euros inclusive of taxes (VAT and other taxes that apply on the day of the order), unless otherwise stipulated, and exclude processing and shipping costs.
These prices are firm and non-revisable during their period of validity, as indicated on the SARL LA COSTE DISTRIBUTION website. They do not include transport and delivery costs which are invoiced in addition.

In all cases, an invoice or a note is drawn up by SARL LA COSTE DISTRIBUTION and given to the Customer on delivery of the products ordered.

All orders, whatever their origin, are payable in euros. SARL LA COSTE DISTRIBUTION reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price in force at the time the order was confirmed, subject to availability.

The products remain the property of SARL LA COSTE DISTRIBUTION until full payment of the price. Note: once you take physical possession of the products ordered, the risks of loss or damage are transferred to you.

SARL LA COSTE DISTRIBUTION reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.

Only persons who are legally responsible and have the capacity to conclude contracts concerning the products proposed by SARL LA COSTE DISTRIBUTION can place an order on the website.

More particularly, and by virtue of article L.3342-1 of the Public Health Code, Customers must have attained the age of majority, namely 18 years.

Article 4 - Confirming your order

Any order confirmation implies your full and complete acceptance of these General Terms and Conditions of Sale, without exception or reserve. All the data provided and the recorded confirmation will imply proof of the transaction. You declare that you are fully aware of this. The order confirmation will imply signature and acceptance of the operations carried out. Orders are firm, final and not subject to modification or cancellation, except under the conditions set out in Article 6 hereof.

 

Article 5 – Payment

Confirming your order implies for you the obligation to pay the price indicated. Your purchases are paid for by credit card.
The card is debited at the time of the order.

 

Article 6 – Retraction

Customers have a right of retraction which can be exercised within 7 calendar days following the date of receipt or withdrawal of the order. In the event that this period expires on a Saturday, Sunday or a public holiday or non-working day, it shall be extended to the first following working day. Customers who wish to exercise their right of withdrawal must return the goods or products within the aforementioned period, in their original packaging, complete, new and in perfect condition.

The cost of returns will be payable solely by Customers.

Product returns must be accompanied by the invoice.

The exchange (subject to availability) or refund will be made within a maximum period of thirty(30) days following the Customers’ request.

 

Article 7- Availability

Our products are proposed for as long as they are visible on the website www.chateau-la-coste.com and subject to available stock. In the event of the product not being available after placing your order, we will inform you by email. Your order will be cancelled automatically and your bank account will not be debited.

 

Article 8 – Delivery

Deliveries are made by an independent forwarding agent with no quantity limit.

Or by a carrier or by postal delivery for 3 or 6 bottles ordered.

SARL LA COSTE DISTRIBUTION undertakes to do its utmost to deliver or ensure the delivery of the products ordered by Customers within a period of fifteen (15) days frompayment of the order.

The products are delivered to the address indicated in the order process. In the event of a shipping delay, an email will be sent to you informing you of any consequences for the delivery date that was indicated to you.

In accordance with Article L.114-1 of the French Consumer Code, Customers may cancel any order exceeding €500 by registered letter with acknowledgement of receipt if the delivery date is exceeded by more than seven days and not due to a case of force majeure.

This sale contract is considered as terminated upon receipt by SARL LA COSTE DISTRIBUTION SARL of the letter by which the Customer informs it of his/her decision, if delivery has not taken place between the sending and receipt of this letter. The Client exercises this right within sixty working days from the date indicated for delivery.

Customers are required to check the condition of the products delivered at the time of delivery. They have a period of three (3) days from delivery to submit by e-mail or post any reservations or claims for nonconformity or visible defect in the products delivered, with all the relevant evidence. After this period and in the absence of having respected these formalities, the products will be considered in conformity and free of any apparent defect and no complaint will be legitimately accepted by SARL LA COSTE DISTRIBUTION.

SARL LA COSTE DISTRIBUTION will replace as soon as possible and at its own expense, the delivered products with visible defects or lack of conformity that have been duly proven by the Customers.

In case of deliveries by a carrier, SARL LA COSTE DISTRIBUTION cannot be held responsible for late delivery due exclusively to the Customer’s unavailability after several suggested appointments.

 

Article 9 – Warranty

All our products benefit from the legal warranty of conformity and the latent defects warranty provided for by articles 1641 and following of the Civil Code.
Any complaints and exchange or refund requests must be sent by recorded delivery within a period of 30 days following delivery.

The provisions of this Article do not prevent you from benefiting from the right of termination provided for in article 6.

 

Article 10 – Liability

The products proposed are conform to French legislation in force. SARL LA COSTE DISTRIBUTION may not be held liable in the case of non-compliancewith the legislation of the country where the product is delivered. It is up to you to check with the local authorities the possibilities for importing or using the products or services you intend to order.

Furthermore, SARL LA COSTE DISTRIBUTION may not be held liable for damages resulting from the incorrect use of the product purchased.

Finally, SARL LA COSTE DISTRIBUTION may not be held liable for any inconveniences or damages inherent to using the internet, in particular a breakdown in service, an external intrusion, or the presence of computer viruses.

 

Article 11 - Applicable law in the event of disputes

The language of this contract is French. These General Terms and Conditions of Sale are subject to French law. In the event of a dispute, the French courts shall have sole jurisdiction.

 

Article 12 - Intellectual property

All the elements of the website www.chateau-la-coste.com are and remain the intellectual and exclusive property of SARL LA COSTE DISTRIBUTION.
